This website and services are operated by Eli Penson Photography. Throughout this site and our services, the terms “we,” “us,” and “our” refer to Eli Penson Photography. By accessing this website, booking a session, or purchasing merchandise, you agree to the following Terms & Conditions.

1. General Use

  • You must be at least the age of majority in your state or province of residence to use this site, book services, or purchase products.
  • You may not use our products or services for any unlawful or unauthorized purpose.

2. Photography & Creative Services

  • By booking a session, you acknowledge that deposits and final payments are non-refundable (see Refund Policy for details).
  • You agree to arrive on time for your scheduled session. If you are late, your session time may be reduced at our discretion.
  • Eli Penson Photography reserves the right to decline service to anyone at any time.

3. Use of Images & Copyright

  • All photographs remain the copyrighted property of Eli Penson Photography unless otherwise agreed upon in writing.
  • Eli Penson Photography retains the right to use images for promotional purposes, portfolio display, social media, website, marketing, and print unless the client explicitly purchases a full copyright release.
  • Clients may use the delivered images for personal, non-commercial purposes (social media, printing, sharing with family/friends) unless a commercial license is purchased.
  • Unauthorized editing, altering, or reselling of images is strictly prohibited.

4. Limitation of Liability

  • Eli Penson Photography is not liable for:
    • Accidents, injuries, or damages occurring during a photoshoot or at a session location.
    • Dissatisfaction due to creative preferences (posing, lighting, editing style, etc.).
    • Loss of images due to events beyond our control (technical failure, theft, natural disaster).

  • In the unlikely event of lost or corrupted files, liability is limited to a refund not exceeding the total amount paid for the session.
  • Clients waive the right to pursue legal claims against Eli Penson Photography for the lawful use of images, delivery timelines within policy, or any damages outside direct service obligations.

5. Merchandise Terms

  • All merchandise sales are final unless an item arrives damaged or defective.
  • Eli Penson Photography is not responsible for shipping delays, lost packages, or incorrect addresses provided at checkout.

6. Indemnification

By booking or purchasing, you agree to indemnify and hold harmless Eli Penson Photography, Stephenson Richie, and all associated staff against any claims, demands, or expenses arising out of your use of our services, website, or products.

7. Governing Law

These Terms & Conditions are governed by the laws of the United States.

8. Updates

We reserve the right to update or change these Terms & Conditions at any time. Continued use of our website or services after updates constitutes acceptance of the new terms.
